CAN-SPAM Act

Sending email is a common practice for personal use and for business. However, one problem is too much being directed from unwanted solicitations. As a result of the issue being completely out of control, a law was enacted in 2003. Under the guidelines of this law, the Federal Trade Commission can enforce fines and other penalties for those that continue to send unwanted emails.

You have likely accessed plenty of web pages where a pop up screen asks you to opt in. You need to fill in your name and your email address. Generally they will offer you something for free such as information. While you do get that, they also are able to send you promotions and offers via email.

All of the materials that a business sends you have to offer a link at the bottom to remove yourself from their mailing list. It they don’t, they can be fined if someone files a report with the FCC. As the owner of a business, you need to have excellent customer service in place to take care of this. Make it a priority to remove such email addresses from your list within 24 hours.

Another problem was explicit materials being sent to email accounts. Under the CAN-SPAM Act they have to be clearly identified in the subject line. This way the recipient knows what they will be opening may be offensive in nature to them. Placing a false message link that is misleading can also lead to huge fines.

Sometimes the material that you send can be classified as SPAM by accident. This is one of the biggest problems with the CAN-SPAM Act. If you use common words found in SPAM such as dear friend, free, or other trigger words you can end up being investigated for it. You will find the process of getting out from under such interrogations is difficult and time consuming.

If you feel you have become the victim of SPAM, you need to file a report online with the FCC. The majority of businesses they catch along such lines have been reported by those that get the messages. There are simply too many businesses out there for the FCC to look out individually.
